Terms & Conditions

These Terms & Conditions ("Terms") explain the general terms on which Domain Services CL ("we", "us" or "our") provides services and allows visitors to use this website. A quote request or enquiry does not by itself create a booking. A booking becomes binding when we confirm it and any stated pre-booking requirements have been met.

Separate signed agreements. Car rental and Britex equipment hire may require a separate written agreement dealing with matters such as identification, authorised users or drivers, bonds, insurance or excess, damage, return obligations and disclosed GPS tracking. If a separate signed agreement is inconsistent with these Terms, the separate agreement applies to that transaction to the extent of the inconsistency. Nothing in either document excludes rights that cannot lawfully be excluded.

1. Services and availability

Our services may include residential and apartment cleaning, post-construction or renovation cleaning, window cleaning, plaster repair, Britex carpet and upholstery cleaning machine hire, and car rental.

Services, vehicles, equipment, dates and time slots are subject to availability. Website content and verbal discussions are not a guarantee of availability until a booking is confirmed.

2. Quotes and scope of work

Quotes are based on the information reasonably available to us at the time, including the scope requested, property condition, access, location, photographs, timing and any special requirements disclosed by the customer.

If the actual site, condition or scope is materially different from what was described, we may pause before starting the affected work, explain the difference and propose a revised scope or price. We will not perform additional chargeable work without the customer's agreement.

Unless a quote states otherwise, it covers only the work expressly described in that quote.

3. Booking confirmation

A booking is confirmed when we communicate confirmation and any stated deposit, bond, identification, signed agreement or other pre-booking requirement has been satisfied.

If we cannot provide a confirmed service for reasons within our control, we will offer a reasonable alternative, reschedule where suitable, or refund any amount paid for the unperformed part of the booking, subject to applicable law.

4. Prices, deposits and payment

Prices are in Australian dollars. The price and payment timing will be stated in the quote, booking confirmation or separate agreement.

Any deposit, bond, administration fee, late-return charge, cleaning charge, damage charge or other additional amount must either be disclosed before the relevant booking or be calculated using a disclosed basis that is reasonable in the circumstances.

We will not rely on these Terms as authority for an unlimited or unspecified deduction from a customer's account. Where an unforeseen amount is claimed, we will provide reasonable information supporting the charge and any dispute rights required by law or the applicable agreement.

5. Cancellations and rescheduling

Please tell us as early as possible if you need to cancel or reschedule. If a cancellation, rescheduling or booking fee applies, it will be disclosed before confirmation and will be limited to an amount that is reasonable in light of the booking, work already performed, costs reasonably incurred and loss that cannot reasonably be avoided.

Where a customer is entitled to cancel because of a failure to meet a consumer guarantee or another legal right, these Terms do not reduce that entitlement.

6. Customer access, safety and property information

For property services, the customer must provide safe and reasonable access at the agreed time and tell us about known hazards, access restrictions, alarms, fragile items, damaged surfaces, special coatings, sensitive materials or other circumstances that may affect the work.

Customers should secure valuables, personal documents and items of unusual value, and keep children and pets safely away from work areas where appropriate.

We may postpone, modify or stop work where conditions are unsafe or where proceeding would create an unreasonable risk of injury or damage. Where practical, we will explain the issue and discuss a reasonable alternative.

7. Cleaning, window and property services

We will provide services with due care and skill. Cleaning results can depend on the age, material and condition of a surface, previous treatment, staining, construction residue, weather, accessibility and pre-existing damage.

Unless we expressly promise a particular result, we do not guarantee that every stain, mark, odour or defect can be fully removed. This does not limit any guarantee that applies under the Australian Consumer Law.

Window or exterior work may be postponed or limited where weather, height, access or site conditions make the work unsafe. Plaster repair is limited to the agreed scope and does not include electrical, plumbing, structural or other licensed trade work unless separately arranged and lawfully performed by an appropriately qualified person.

8. Britex equipment hire

Britex machine hire is subject to availability and the separate Domain Services CL equipment hire agreement. The hirer must follow operating instructions, use the equipment only for appropriate purposes, take reasonable care of the machine and accessories, and return them at the agreed time and in the required condition, allowing for fair wear and tear.

The hirer is not responsible for pre-existing faults or damage that the hirer did not cause. Where loss or damage is claimed, responsibility and any amount payable will be determined under the hire agreement, the circumstances and applicable law.

9. Car rental

Car rental is subject to vehicle availability and a separate rental agreement. The renter and each authorised driver must satisfy the licence, identification, age, insurance and other eligibility requirements disclosed for the booking.

The rental agreement governs the rental period, bond, insurance or excess, authorised drivers, fuel, tolls, infringements, accidents, damage, theft, breakdowns, vehicle return and any disclosed tracking terms.

Domain Services CL remains responsible for maintaining rental vehicles in a condition required by law. A customer's inspection or condition acknowledgement does not transfer responsibility for hidden mechanical or safety defects that the customer could not reasonably identify.

10. Condition records, damage and additional charges

We may record the condition of hired equipment or a rental vehicle at collection and return using an inspection form, photographs or video. Customers should raise any visible discrepancy as soon as reasonably practicable.

If we claim an unforeseen charge for damage, missing equipment, excessive cleaning or another post-return matter, we will provide reasonable details supporting the claim. For vehicle damage, an itemised amount and a reasonable opportunity to dispute the charge will be provided where required by law.

A customer is responsible only to the extent provided by the applicable agreement and law, including for loss or damage caused by the customer's breach, negligence, misuse or failure to take reasonable care.

11. GPS tracking and location technology

A vehicle or Britex machine may be fitted with GPS or other location technology only where this is disclosed for the relevant booking. Where Victorian law requires consent from the person in lawful possession or control of the object, we will obtain the required consent before or when possession is provided.

Tracking information may be used only for disclosed and legitimate purposes such as security, theft or loss prevention, locating overdue or unreturned property, recovery, investigating suspected unauthorised use, safety, insurance or legal requirements. Further details are set out in the applicable rental or hire agreement and our Privacy Policy.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Where the Australian Consumer Law applies, services must be provided with due care and skill, be reasonably fit for any purpose made known to us where that guarantee applies, and be supplied within a reasonable time where no time is fixed.

Goods supplied in connection with a hire or rental may also be subject to applicable consumer guarantees. If a consumer guarantee is not met, the customer may be entitled to a remedy such as repair, replacement, re-performance of a service, cancellation, refund or compensation, depending on the circumstances and applicable law.

13. Liability and responsibility

Nothing in these Terms limits liability that cannot lawfully be limited. Subject to that, each party is responsible for loss or damage to the extent caused by that party's breach, negligence, misuse or failure to take reasonable care.

We are not responsible for pre-existing defects, damage or deterioration that we did not cause, or for loss that results solely from inaccurate or incomplete information supplied to us where it was reasonable for us to rely on that information.

14. Events outside reasonable control

We may need to delay, suspend or reschedule a service because of events outside our reasonable control, including dangerous weather, road closures, emergencies, sudden loss of safe site access or unexpected equipment or vehicle failure despite reasonable maintenance.

Where this occurs, we will communicate with the customer and take reasonable steps to minimise inconvenience. This clause does not remove any refund, cancellation or other right that applies under law.

15. Website information and enquiries

We take reasonable care to keep website information accurate, but service descriptions, photographs, prices, vehicles, equipment and availability may change. Photographs may show examples of previous work or fleet vehicles and do not guarantee an identical result or the availability of the exact item shown.

A website enquiry or quote request is not a confirmed booking until we confirm it.

You must not misuse the website, attempt unauthorised access, introduce malicious code or use our content in a way that infringes our rights or the rights of others.

16. Intellectual property

Unless otherwise stated, the Domain Services CL name, branding, logo, website design, written content and original photographs are owned by or used with permission by Domain Services CL. They must not be copied, reproduced or used commercially without permission, except as permitted by law.

17. Third-party platforms and links

Our website may link to third-party platforms such as Instagram, Facebook, email, map, payment or other services. Those services operate independently and may have their own terms and privacy practices. We are not responsible for their independent acts or omissions, subject to any rights that cannot lawfully be excluded.

18. Privacy

We handle personal information in accordance with our Privacy Policy and any collection notice or consent that applies to a particular service. GPS tracking requires separate disclosure and, where required, consent under the applicable hire or rental documentation.

19. Complaints and disputes

If you have a concern, please contact us first and provide the booking or service details, what happened and the outcome you are seeking. We will review the matter and try to resolve it within a reasonable time.

If a consumer dispute cannot be resolved directly, you may be able to seek assistance from Consumer Affairs Victoria or make an application to the Victorian Civil and Administrative Tribunal (VCAT), depending on the matter. Regulatory reports may also be made to the ACCC where appropriate.

20. Changes to these Terms

We may update these Terms for future transactions when our services, business practices or legal requirements change. Updated Terms apply prospectively from the date they are published. Terms already agreed for a confirmed booking or signed transaction will not be retrospectively changed unless the parties agree or the law permits or requires the change.

21. Severability and no waiver

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law.

If we do not immediately enforce a right under these Terms, that does not mean we permanently give up that right.

22. Governing law

These Terms are governed by the laws applying in Victoria, Australia. The parties submit to courts and tribunals with jurisdiction in Victoria, subject to any rights a customer has under applicable consumer law.
